United States District Court of the North District of California
On October 09, 2002, Angel Raich, et al. filed a civil lawsuit against the United States Attorney General and the Administrator of the Drug Enforcement Administration (DEA). On March 5, 2003, the district court denied the Plaintiffs’ motion for a preliminary injunction.
United States Court of Appeals for the Ninth Circuit
The Plaintiffs won in the Ninth Circuit Court of Appeals on December 16, 2003. The federal government lost its motion for rehearing and rehearing en banc on February 25, 2004.
On April 20, 2004, John Ashcroft, et al. filed a Petition for a Writ of Certiorari in the United States Supreme Court; at that time the case name changed to Ashcroft, et al. v. Raich, et al. The Supreme Court granted cert., and on June 6, 2005, reversed and remanded.
United States Court of Appeals for the Ninth Circuit -- After Remand from the Supreme Court
The United States Supreme Court sent our case back to the Ninth Circuit Court of Appeals. Angel McClary Raich, et al. are again the Plaintiffs-Appellants, and Alberto R. Gonzales, et al. are the Defendants-Appellees.
