Joshua D. Greenberg practice focuses on products-liability and appellate litigation. Before joining Covington and Burling, Josh clerked for Judge Thomas L. Ambro of the U.S. Court of Appeals for the Third Circuit from 2001 to 2002.


Josh has a proven record of successfully representing clients in a diverse array of challenging cases in federal and state courts across the nation, ranging from trial courts in the District of Columbia, Texas, New York, and West Virginia to the U.S. Supreme Court. Josh focuses his practice on complex civil litigation and also has handled criminal matters. Areas in which he has substantial experience includes products-liability and consumer-protection lawsuits by individuals, putative classes, and state attorneys general; judgment-enforcement and breach-of-contract actions involving real estate; and white-collar prosecutions. Josh has particular experience defending pharmaceutical companies, especially prescription drug manufacturers, against claims alleging personal injuries, misleading marketing, and off-label promotion.


An accomplished oral advocate, Josh has excelled in arguing dispositive motions, other pretrial motions, and appeals. In addition, Josh has authored or coauthored more than 100 trial-level and appellate briefs, on issues such as the admissibility of expert testimony under the Daubert and Frye tests, preemption of state-law claims, transfer of lawsuits for consolidation in multidistrict litigation proceedings, the adequacy of product warnings, standing to assert consumer-protection claims, the scope of federal criminal statutes, and various questions of constitutional law.

A key member of multiple trial teams that have obtained favorable results, Josh is skilled in developing detailed knowledge of complicated facts and in preparing to examine both friendly and hostile witnesses. Josh has also taken and defended numerous depositions – many of which involved a witness designated as an expert – and has obtained documents and testimony in foreign nations by letters rogatory.


Josh served as a Law Clerk for The Honorable Thomas L. Ambro of the U.S. Court of Appeals for the Third Circuit. Josh earned his J.D., with honors, from Stanford Law School, where he was an Associate Editor of the Stanford Law Review.    <Read more...>
